These Terms of Service (“Terms”) govern your access to and use of eSalona (the “Service”), including esalona.com, salon tenant websites, the salon admin portal, APIs, and related products. The Service is operated by Websifier (“Websifier”, “we”, “us”, “our”). By creating an account, registering a salon, or using the Service, you agree to these Terms and our Privacy Policy.
1. Who may use eSalona
The Service is intended for salon owners, beauty businesses, and their authorized staff. You must be at least 18 years old and able to form a binding contract. You represent that information you provide is accurate and that you have authority to bind the business you register.
2. Accounts and salon registration
You are responsible for safeguarding login credentials and for all activity under your account. Notify us promptly at hello@esalona.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a security risk.
3. Subscriptions and billing
- New salons start on the Free plan as described on our Pricing page.
- Paid plans (Pro and Business) are billed in advance on a monthly or annual basis through secure online checkout.
- Prices, plan limits, and features are described on esalona.com and in your admin portal.
- You authorize us and our payment processor to charge applicable fees and taxes.
- Failure to pay may result in suspension or downgrade of your salon account.
Refunds and cancellations are described in our Refund Policy.
4. Salon websites and end-customer bookings
Salon owners use eSalona to publish websites and accept appointments. You are solely responsible for:
- Content on your public site (services, prices, images, claims, and promotions);
- Honoring appointments and communicating with your clients;
- Complying with local laws for beauty, health, and consumer services;
- Providing privacy notices to your clients where required;
- Handling disputes with your customers regarding services performed at your business.
eSalona provides software infrastructure. We are not a party to transactions between salons and their clients except for platform subscription fees paid to Websifier.
5. Payments and client payouts
Where enabled, salons may connect a payment account to receive booking-related payments online. Your payment provider’s terms and privacy policy apply to payment processing. Websifier is not a bank and does not hold client funds except as part of platform billing. You must complete payment provider onboarding and maintain an account in good standing to receive payouts.
6. Acceptable use
You agree not to:
- Use the Service for unlawful, fraudulent, or harmful purposes;
- Upload malware, spam, or content that infringes intellectual property or privacy rights;
- Attempt to probe, scan, or compromise platform security;
- Resell or sublicense the Service without written permission;
- Misrepresent your business category or impersonate another salon or brand.
7. Intellectual property
eSalona software, branding, documentation, and default themes are owned by Websifier or its licensors. You retain ownership of content you upload. You grant us a limited license to host, display, and process your content solely to operate the Service.
8. Service availability and changes
We strive for reliable uptime but do not guarantee uninterrupted access. We may modify features, plans, or these Terms. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance where permitted by law.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT BOOKING AVAILABILITY WILL ALWAYS MATCH IN-SALON CAPACITY.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBSIFIER AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID TO WEBSIFIER FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Websifier from claims arising out of your use of the Service, your salon content, your treatment of end customers, or your violation of these Terms or applicable law.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach, non-payment, or legal requirements. Upon termination, your right to use the Service ends. Provisions that by nature should survive (payment obligations, disclaimers, liability limits) will survive.
13. Governing law and disputes
These Terms are governed by applicable law without regard to conflict-of-law principles. Disputes should first be raised with us at hello@esalona.com. Where required by local consumer protection rules, mandatory rights in your country of residence remain unaffected.
